Introduction

This Privacy Policy outlines Interlloyd Averij b.v.  (" we ", " our " or " the Company ") practices with respect to information collected from users who access our website at interlloydclaims.nl (" Site "), or otherwise share personal information with us (collectively: " Users "). 

Grounds for data collection 

Processing of your personal information (meaning, any information which may potentially allow your identification with reasonable means; hereinafter " Personal Information ") is necessary for the performance of our contractual obligations towards you and providing you with our services, to protect our legitimate interests and for compliance with legal and financial regulatory obligations to which we are subject.


When you use the Site, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy.



We encourage our Users to carefully read the Privacy Policy and use it to make informed decisions.

Interlloyd Group B.V. stands for clarity and plain language. Therefore, we also want to be clear to you about the use of your personal data. Interlloyd Group B.V. handles and processes your personal data in accordance with the applicable privacy legislation, including the General Data Protection Regulation (hereinafter referred to as “GDPR”).

Where this privacy statement refers to “Interlloyd”, the following companies are jointly referred to:

Interlloyd offers a wide range of services: providing expertise in the event of damage, handling claims for insurers, recourse and advising its customers where the logistics chain is concerned in a broad sense.


What are personal data?

Personal data means data that can be (in)directly traced to an individual natural person such as a name and address. In addition, the law recognizes special personal data. These are sensitive data that require extra protection. Examples are the BSN number and health or medical data.

Processing personal data includes everything that can be done with it, such as collecting, storing, organizing, transferring within or outside the organization, retrieving, consulting, linking, archiving and deleting from the records.


Within Interlloyd, employees can only access your personal data when necessary for the performance of their duties. All employees have a duty of confidentiality. Personal data are processed only for the purpose for which they were obtained.


What does Interlloyd process personal data for?

Interlloyd cannot carry out its activities without processing personal data. The processing takes place, in summary, for the following purposes:

  • To maintain contact with our customers and to handle inquiries;
  • To maintain a process for handling complaints;
  • To execute the contracts entered into and to provide our services;
  • To maintain correct accounts receivable, accounts payable and payroll records;
  • To be able to have audits carried out;
  • To comply with our other legal obligations;
  • To be able to continuously optimize our services.

Which personal data does Interlloyd process?

We hold personal data that you have provided to Interlloyd yourself because you use(d) our services. In addition, we consult public sources in which personal data may be available. Interlloyd processes personal data of employees and job applicants. If it involves special personal data, for example health data or criminal data, Interlloyd processes it only when, and in the manner permitted.


Retention of personal data

The AVG does not specify retention periods for personal data. When retaining personal data, we act in accordance with the retention obligations contained in various legal provisions for this purpose.


Providing personal data to others

If necessary, we provide personal data to external parties. These may be recipients, processors and third parties (being non-processors).

Recipients:

When there is a basis or the purpose is consistent with the purpose for which the personal data was provided to us, we provide personal data to another department(s) within Interlloyd. The same applies to the provision to suppliers or (independent) service providers of Interlloyd.

Processors:

We sometimes commission an external party to perform certain work for us. From the point of view of the AVG, such a party is then a service provider, but also a processor. We enter into a contract with such a party that stipulates that that party will process all personal data securely, exclusively for the purpose for which the assignment was given.

Third parties, being non-processor:

This takes place only if there is a legal obligation to do so, or if you gave your consent to do so. If you have given that consent to the transfer of your personal data, Interlloyd is not responsible for the further processing of that data.


We secure your data

Interlloyd takes appropriate (to standards generally accepted within the industry) technical, organizational and operational measures to secure your personal data. This security focuses against loss or any form of unlawful processing. Persons who have access to personal data on behalf of Interlloyd are bound to secrecy. We ask that you contact us (at info@interlloyd.nl) if you have any questions about our security of your personal data or if you have reason to suspect misuse. Interlloyd complies with the Data Breach Notification Act.


Your rights are respected

You may request that we correct, supplement, delete or block your data if it is incomplete, inaccurate or processed in violation of a legal requirement. You also have the right to request the data we hold on you. At your request, we will also provide you with this data (digitally).

You have the right to object to the processing of your personal data with us. When we are legally obliged to do so, we will terminate the processing and remove your data.


Changes to this Privacy Statement

If changes occur in the processing operations or applicable legislation, we have the right to amend this Privacy Statement. The current version of the Privacy Statement can be found on our website www.interlloydclaims.nl.

 

 

Addition: Website 

We and our trusted partners use cookies and other technologies in our related services, including when you visit our Site or access our services. 


A "cookie" is a small piece of information that a website assign to your device while you are viewing a website. Cookies are very helpful and can be used for various different purposes. These purposes include allowing you to navigate between pages efficiently, enable automatic activation of certain features, remembering your preferences and making the interaction between you and our Services quicker and easier. The Site uses the following types of cookies:

We also use a tool called “ Google Analytics ” to collect information about your use of the Site. Google Analytics collects information such as how often users access the Site, what pages they visit when they do so, etc. We use the information we get from Google Analytics only to improve our Site and services. Google Analytics collects the IP address assigned to you on the date you visit sites, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy .

Addition: Newsletter 

When you receive our newsletter we therefore proces only your name and emailadress. It is our goal to inform you about our services. With our mailingprovider Mailchimp we signed an appropriate data processing agreement.


The legal basis for our use of the newsletter is the need for our legitimate interest to keep receivers up to date with news concerning our services and the field of handling Cargo & Marine claims. Receiver can easily opt out any time.


The related personal data will be processed as long as you are registered for our newsletter. When opting out, we have to process your data in order to make sure that you do not receive a newsletter anymore.

General additions

Third party collection of information

Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to. 


This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy. 

How do we safeguard your information?

We take great care in implementing and maintaining the security of the Site and your information. Through our website and newsletter related service suppliers we employ industry standard procedures and policies to ensure the safety of the information we collect and retain, and prevent unauthorized use of any such information, and we require any third party to comply with similar security requirements, in accordance with this Privacy Policy. Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our Site, and we make no warranty, express, implied or otherwise, that we will prevent such access.

Transfer of data outside the EEA 

Please note that some data recipients may be located outside the EEA. In such cases we will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.

Marketing

We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials, concerning our services, which we believe may interest you. 


Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists. 


Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.

Corporate transaction

We may share information in the event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.

Minors

We understand the importance of protecting children’s privacy, especially in an online environment. The Site is not designed for or directed at children.
